Dasuki: ECOWAS Court to Deliver Ruling on Jurisdiction, April 11

 The Community Court of Justice, ECOWAS, has set aside April 11 as the day to deliver a ruling as to whether it has jurisdiction over a suit initiated by the immediate past National Security Adviser (NSA), Sambo Dasuki. It would be recalled that the suit, designated ECW/CCJ/APP/01/16 was filed on November 5, 2015, against the Federal Government. The court arrived at the decision following a preliminary objection raised by counsel to the defendant, Mr. T. A. Gadzali. According to the objection, Gadzali prayed the court to refuse hearing of the substantive suit initiated by Dasuki since the subject of the suit was on the basis of contempt of the order of Nigerian courts. Gazali stated that the only remedy was for the plaintiff to return to the Nigerian court so as to commit the government for contempt. The lawyer further contended that a similar case was already pending before a Nigerian court and could not, therefore, be entertained by the ECOWAS Court. Responding, lawyer to the plaintiff, Robert Emukpoeruo, insisted that a suit could not only be filed before the ECOWAS Court if it were pending before an international court. He said the action was not hinged on contempt but on the defendant’s abuse of the applicant’s human rights. Specifically, Dasuki is asking the ECOWAS Court for an award in his favour, N500 million compensatory damages against the government of Nigeria.
